Terms of Use

1. Agreement to Terms
By accessing or using HyperSinc at https://hypersinc.com (the "Platform"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree, do not use the Platform. These Terms apply to all visitors, subscribers, and Pro account holders.
HyperSinc is operated as a private intelligence publication. Access to certain features requires a paid Pro subscription.
2. Description of Service
HyperSinc is an emerging technology intelligence platform that publishes editorial analysis, market intelligence, deal flow data, competitive benchmarks, market sizing models, and weekly intelligence reports across five verticals: Freedom Tech, Deep Tech, Clean Tech, Energy, and Space Tech.
Content on the Platform is compiled from publicly available sources, SEC filings, government databases, and original editorial analysis. HyperSinc is not a broker-dealer, investment adviser, or financial services firm.
3. Not Investment Advice
Nothing on HyperSinc constitutes financial, investment, legal, or tax advice. All content is provided for informational and research purposes only. No content on the Platform should be construed as a recommendation to buy, sell, or hold any security, asset, cryptocurrency, or investment product. HyperSinc is not a registered investment adviser under the Investment Advisers Act of 1940 or any applicable state law.
Forward-looking statements, market sizing projections, and competitive analysis are based on information available at the time of publication and are subject to significant uncertainty. Past performance of any company, sector, or technology discussed on the Platform is not indicative of future results.
Always consult a qualified financial, legal, or tax professional before making any investment or business decision.
4. Pro Subscription
Billing. Pro subscriptions are billed monthly at the price displayed at the time of purchase. Payments are processed by Stripe. By subscribing, you authorize HyperSinc to charge your payment method on a recurring monthly basis until you cancel.
Cancellation. You may cancel your subscription at any time. Your access will continue through the end of the current billing period. We do not provide partial refunds for unused time within a billing period unless required by applicable law.
Refunds. If you are unsatisfied with your first month, contact us at legal@hypersinc.com within 7 days of your initial charge and we will issue a full refund. After the first month, refunds are issued at our discretion.
Account access. Your Pro credentials are for your personal use only. You may not share, resell, or transfer your account or provide access to any third party. We reserve the right to suspend accounts used in violation of this policy.
Price changes. We reserve the right to change subscription pricing with at least 30 days' notice to active subscribers by email. Continued use after a price change constitutes acceptance.
5. Permitted Use
Subject to these Terms, HyperSinc grants you a limited, non-exclusive, non-transferable right to access and use the Platform for your personal or internal business research purposes.
You may not:
- Copy, reproduce, redistribute, or republish any content from the Platform without our written permission.
- Scrape, crawl, or use automated tools to extract content from the Platform.
- Resell, sublicense, or commercially exploit Platform content or reports.
- Use the Platform to train machine learning models or build competing products.
- Reverse engineer any part of the Platform.
- Attempt to gain unauthorized access to any account, system, or database.
- Transmit spam, malware, or any harmful code through the Platform.
Reasonable internal sharing (e.g., forwarding a report within your organization) is permitted. Large-scale redistribution or public republication is not.
6. Intellectual Property
All editorial content, report formats, designs, software, and branding on the Platform are owned by HyperSinc or our licensors and are protected by copyright, trademark, and other intellectual property laws.
Data sourced from public government databases (SEC EDGAR, USASpending.gov, NSF, USPTO) is in the public domain. Our selection, arrangement, analysis, and presentation of that data is original work protected by copyright.
You retain ownership of any information you submit to us (e.g., contact messages). By submitting, you grant us a limited license to use that information to respond to you.
7. Third-Party Content and Sources
HyperSinc articles link to and cite third-party publications, company announcements, government filings, and other sources. We do not endorse, control, or guarantee the accuracy of third-party content. Links to external sites do not imply affiliation or endorsement.
We make reasonable efforts to ensure factual accuracy but cannot guarantee that all information on the Platform is complete, current, or error-free. If you identify an inaccuracy, please contact us at legal@hypersinc.com.
8. Disclaimers
THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
We reserve the right to modify, suspend, or discontinue any part of the Platform at any time without notice. We are not liable for any such modification, suspension, or discontinuation.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HYPERSINC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE PLATFORM, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO HYPERSINC IN THE 12 MONTHS PRECEDING THE CLAIM.
10. Indemnification
You agree to indemnify and hold harmless HyperSinc and its officers, directors, employees, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms, your use of the Platform, or your violation of any third-party rights.
11. Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising from or relating to these Terms or the Platform shall be resolved by binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to a jury trial or to participate in a class action lawsuit.
Nothing in this section prevents either party from seeking injunctive or other equitable relief in court for violations of intellectual property rights.
12. Modifications to Terms
We may update these Terms from time to time. We will post the updated Terms on this page with a new effective date. For material changes, we will notify Pro subscribers by email at least 14 days before the changes take effect. Your continued use of the Platform after the effective date constitutes acceptance of the updated Terms.
13. Termination
We may suspend or terminate your access to the Platform at any time if you violate these Terms, engage in fraudulent activity, or for any other reason at our sole discretion. Upon termination, your right to access the Platform ceases immediately. Sections 3, 6, 8, 9, 10, and 11 survive termination.
